The attorney was fined. The AI developer was not.

The moral crumple zone.
Madeleine Clare Elish's 2019 term for the human in an AI-assisted system who absorbs blame the system produced. The crumple zone is designed to fail — it exists to protect the system from accountability.
In a car crash, the crumple zone deforms to absorb impact and protect the passenger. In an algorithmic failure, the moral crumple zone works similarly: the human nearest the decision — the nurse who administered the wrong dose because the algorithm flagged it as safe, the judge who set bail based on the risk score, the hiring manager who followed the ATS ranking — absorbs moral and legal responsibility for an outcome the system shaped.
The asymmetry is significant: the system cannot be held morally responsible, does not lose its job, cannot be sued for malpractice. The human in the crumple zone often had limited ability to meaningfully override the recommendation, limited visibility into how it was generated, and limited time to verify it. They are blamed for the failure of a system they didn't build and in many cases didn't choose.

What experiments show about AI and agency.
Caspar et al. (Scientific Reports, 2025) — Drone operator study
Finding: Operators who received AI advice before making a targeting decision felt measurably less moral responsibility for outcomes — even when they knew the advice was wrong and overrode it. The presence of a recommendation alone shifted their sense of agency.
Implication: You don't have to follow an AI recommendation for it to diffuse your sense of moral ownership. Exposure to a recommendation changes how you experience the decision.
Social Science & Medicine (2026) — Medical AI and patient blame
Finding: Patients assigned significantly less moral blame to physicians who incorporated AI recommendations into treatment decisions — with the effect strongest for personalized treatment plans. Physicians were perceived as less culpable when 'the algorithm agreed.'
Implication: AI involvement in medical decisions changes how patients (and potentially juries) assign responsibility. This creates professional incentives to use AI not for its accuracy, but for its accountability-diffusing properties.

Finding: AI recommendations sometimes reduce unethical intent — but in cases where the recommendation itself was questionable, they produced measurable moral disengagement: users felt less troubled by decisions they would have hesitated over without AI involvement.
Implication: AI can make people more comfortable with decisions they know, on some level, are wrong. The recommendation functions as an alibi that pre-clears the moral account.

Why this is a moral offloading case, not just a competence case
The factual error was bad. The moral structure was more interesting: the attorneys did not feel responsible for verifying an AI output that they were going to submit under their signatures to a federal judge. The AI had produced confident-sounding text. They had delegated the epistemic labor — and with it, their sense of authorship and accountability for the content. The attorney who signs a brief is legally responsible for its contents, regardless of what tool produced the draft. That principle had to be restated by a federal judge.
The problem of many hands.
When many actors contribute to an outcome — AI developer, deploying organization, interface designer, end user — responsibility becomes so distributed that no one feels fully responsible. This is not an accident; it is a structural feature of complex systems.
Who built the AI?
The foundation model developer trained it on vast data, made design choices about what to optimize for, and released it commercially. They typically disclaim liability for downstream uses in their terms of service.
Who deployed it?
An organization integrated the model into a product or workflow, chose how to present its recommendations, and decided what level of human oversight to require. They bear accountability for the deployment decision.
Who designed the interface?
Interface choices determine whether recommendations are presented as suggestions or conclusions, whether uncertainty is visible, and whether overriding AI is easy or friction-laden. These shape behavior without appearing on the accountability ledger.
Who acted on it?
The end user made the final decision — often under time pressure, with limited information about the AI's basis, and with strong social or institutional pressure to follow algorithmic recommendations. They are the moral crumple zone.
What accountability actually requires.
Named human authorship
Every consequential AI-assisted output needs a human who says: 'I reviewed this. I'm responsible for it.' Not a policy that requires review — a named person who performed it.
Visibility into the recommendation basis
Accountability requires the ability to evaluate. A recommendation from a black-box system that cannot explain its reasoning cannot be meaningfully verified — only accepted or rejected. Verification requires transparency.
Practical ability to override
A human in a system where overriding AI recommendations is procedurally difficult, culturally stigmatized, or time-prohibitive is not meaningfully accountable for following them. Real accountability requires real optionality.
Tracking of AI involvement
If you don't know which decisions involved AI recommendations, you cannot audit for AI-driven harm patterns. Documentation of AI involvement is a prerequisite for accountability at the institutional level.

For yourself
- Own your AI-assisted decisions explicitly. Before acting on an AI recommendation, say out loud (or write): 'I reviewed this and I'm responsible for it.'
- Notice when you feel less responsible for an outcome because AI was involved. That feeling is the moral offloading reflex — it is worth examining, not acting on.
- When AI contributes to a bad outcome, resist attributing the failure to 'the AI.' Who deployed it, who chose to rely on it, who failed to verify?
For a professional
- Document the human review step explicitly in any decision record where AI contributed. 'I reviewed the AI recommendation and determined...' creates accountability that 'the AI recommended...' doesn't.
- Ask your organization: does our AI use policy create accountability, or does it create plausible deniability?
- In high-stakes domains (medicine, law, hiring, criminal justice), treat AI recommendations as drafts requiring human authorship, not outputs requiring human signature.
For an organization
- Map the accountability chain for every AI-assisted decision. Who is responsible if the AI recommendation is wrong and someone is harmed?
- Require named human accountability on AI-assisted outputs — not 'approved by AI review' but 'approved by [name], reviewed against AI recommendation.'
- Review your indemnification language. If your contracts outsource AI liability to vendors, you may have created accountability gaps that litigation will eventually fill.
For policy
- Establish liability standards that follow function, not label: if a system makes a decision that affects someone's rights, the accountability chain should be traceable regardless of whether 'AI' is in the product name.
- Require disclosure of AI involvement in consequential decisions: healthcare, hiring, housing, lending, criminal justice.
- Fund research on moral disengagement in AI-adjacent professional settings — current evidence is thin outside controlled experiments.
